Why Is Bob Baffert #Banned and Steve Asmussen is still racing in the Kentucky Derby?

Please ask the KHRC to articulate their reasoning and decision making process. I am not understanding it. XOXO
Update: Steve Asmussen also had a fractured horse named "La Crete" also raced at Churchill Downs.
Worth noting is PETA owns a stake in both of these racetracks and profitted off of this racehorse injury/races.
